Terms of Use
This Terms of Use Agreement states the terms and conditions that govern the contractual agreement between pennantcap.com, (the “Provider”) and you (the “User”) who agrees to be bound by this Agreement in regard to User’s access pennantcap.com (the “Site”).
1. SITE CONTENT
The content and information displayed on the Site is the property of the Provider. The downloading, reproduction, or retransmission of any of the Site’s content, other than for non-commercial individual use, is strictly prohibited without the prior written consent of the Provider. Content may change without notice.
2. THIRD PARTY DEVICES
User agrees they will not use any device, software or other instrumentality to interfere or attempt to interfere with the proper working of the Site, and that User will not take any action that imposes an unreasonable or disproportionately large load on the Site’s infrastructure. User agrees they will not use any robot, spider, other automatic device, or manual process to monitor or copy any content from the Site without the prior express consent from an authorized Provider representative, unless such use is by a search engine employed to direct Internet users to the Site.
3. INTELLECTUAL PROPERTY
The Site may contain or reference trademarks, patents, copyrighted materials, trade secrets, technologies, products, processes or other proprietary rights belonging to Provider and/or other parties. No license to or right in any such trademarks, patents, copyrighted materials, trade secrets, technologies, products, processes and other proprietary rights of Provider and/or other parties is granted to or conferred upon User.
4. LIMITED LIABILITY
All Provider information is provided “as is” without warranty of any kind, either express or implied, including , but not limited to, the implied warranties of merchantability, fitness for a particular purpose, or non-infringement unless otherwise required by law.
5. COMMUNICATIONS
Provider [or is this suppose to be User??] shall be free to reproduce, use, disclose, and distribute any and all communication conducted with Provider through the Site including but not limited to feedback, questions, comments, suggestions and the like. User shall have no right of confidentiality in such communications and Provider shall have no obligation to protect User’s communications from disclosure. Provider shall be free to use any ideas, concepts, know-how, content or techniques contained in User’s communications for any purpose whatsoever, including but not limited to the development, production and marketing of products and services that incorporate such information.
6. ERRORS AND OMISSIONS
The Site may contain technical inaccuracies and typographical errors, including but not limited to inaccuracies relating to pricing or availability applicable to User’s transaction. Provider shall not assume responsibility or liability for any such inaccuracies, errors or omissions, and shall have no obligation to honour information affected by such inaccuracies. Provider reserves the right to make changes, corrections, cancellations and/or improvements to any information contained on the Site, and to the products and programs described in such information, at any time without notice, including after confirmation of a transaction.
7. PRODUCTS AND SERVICES
The Site may contain information on Provider’s products and services, not all of which are available in every location. A reference to a Provider product or service on the Site does not imply that such product or service is or will be available in User’s location.
8. THIRTY PARTY LINKS
There are links on the Site that lead to third party sites, including those of advertisers. Provider is not responsible for the privacy policies of those sites or the cookies those sites use in addition, because Provider has no control over such sites and resources, User acknowledges and agrees that Provider is not responsible for the availability of such external sites or resources, and does not endorse and is not responsible or liable for any content, advertising, products, or other materials on or available from such sites or resources.
